Manufacturers of fast-moving goods (FMCG) often develop innovative packaging in order to differentiate their products from the competition in a crowded market. Shape trade marks now offer the possibility of legal protection for FMCG and their packaging, although brand owners have encountered difficulties in attempting to register common shapes of FMCG and simple variations on those shapes.
