On 23 October 2024, in Case T-25/23, the General Court of the EU, for the first time found, in essence, that a registered EU design which consists of views that are not conclusive and present at least two different designs must be deemed invalid. Surprisingly, despite its potential impact on the validity of countless registered EU designs, the decision has not yet attracted the attention that it should have received amongst those interested in EU design law. While the outcome of T-25/23 is beyond doubt, the standards suggested to be applied for reaching that result are less persuasive.
