Act No. 258/2000 Coll., on the protection of public health and on amendments to certain related acts, as amended up to 30 September 2023 (Public Health Protection Act), Sec. 69; Act No. 94/2021 Coll., on the emergency decrees during an epidemy of COVID-19 and on amendments to certain related acts, as amended up to 14 January 2022 (Pandemic Act), Sec. 2; Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), Arts. 4(2) and 5(1)(b) ‒ čTečka Headnotes by Pavel Koukal and Michal Ježek 1. The healthcare administrative authority issuing an emergency decree cannot restrict activities or impose blanket rules solely by referring to the current epidemic situation in the region without providing further justification. 2. Unless the entire State is officially deemed the centre of an infectious disease outbreak, it cannot be presumed without further evidence that everyone is a suspected infectious person.
