Outline: The key aspects of a personality right : An individual has the right to prevent his persona from being commercially exploited without his consent; There should be no requirement for the individual to have to prove confusion of any kind; To establish infringement there should also be no requirement to prove damage. Damage should only be relevant in assessing the suitable remedy; As with other intellectual property rights, the personality right sould be capable of assignment; As with copyright, the personality right sould also be an asset capable of inheritance with a limited term of post-death protection; In the interests of protection of free speech, the personality right should only prohibit use of persona for commercial purposes;.
