Summary
This article explores the legal landscape of intellectual property and competition law as it applies to food production in Argentina. It describes the particular situation of Argentina as a developing country with significant exportable food surpluses, and analyzes the peculiarities of Argentina’s legal system in relation to food and agriculture. It looks in particular at the weakness of certain aspects of intellectual property protection, the pervasive use of export taxes and price controls, and the policy fluctuations between either promoting or discouraging exports. It also examines the political economic aspects of the legal peculiarities and makes proposals for improving the legal framework governing food production.
