Résumé
Few if any decisions of the EPO Enlarged Board of Appeal can ever have been so widely welcomed by the patent profession across Europe as that on legal priority in G 1/22 and G 2/22 Entitlement to Priority. This article traces the development of English law in the same area and considering, in the light of this, what if any effect the Enlarged Board decision is likely to have on English law as it now stands.
