EU sui generis GIs for agricultural products and foodstuffs: the case for a single quality scheme

This article examines whether the current EU sui generis Geographical Indications system for the protection of place-specific agricultural products and foodstuffs can be simplified. Currently, the system consists of two quality schemes: Protected Designation of Origin (PDO) and Protected Geographical Indication (PGI). The article investigate the possibility of transforming this regime into a one-label system based on a single quality scheme: Geographical Indication (GI), modelled on PGI. By utilising a mixed historical and empirical approach, including previously unpublished data, this work argues that there is no inherent barrier, based on the history, functioning, and relevant trends of EU GIs for agricultural products and foodstuffs, to prevent the transformation of this regime into a one-label system. Thus, in theory, a radical simplification of this area of EU Intellectual Property Law is possible.
