Summary
This article examines legal issues of contention related to trade mark acquiescence commenting upon the recent decisions of the CJEU and the Court of Appeal on the topic. Among others, it addresses the following questions from a law and policy perspective: what kind of action needs to be taken against the later user so that the limitation period of statutory acquiescence is effectively interrupted?; and b) should an alleged infringer be allowed to raise a defence based on common-law acquiescence?
