Summary
This journal has reported on the progress of a sad and costly dispute from the New Zealand Family Court to the Court of Appeal. The dispute concerns the division of artworks and copyrights on divorce between the artist Sirpa Alalääkkola and her ex-husband Paul Palmer. In the final episode, the Supreme Court has confirmed that copyrights, as personal property, are divisible assets under New Zealand’s deferred community of property regime. While the decision is not beyond critique, it provides a pragmatic scheme for dividing the artworks and especially copyrights for an artist whose artistic practice includes production of singular artefacts and exploitation of copyright. This ruling by a senior common law court is likely to be relevant for other jurisdictions which have similar marital property regimes.
