This article reviews TVIS Limited v Howserv Services Limited in which the Court of Appeal allowed TVIS’s appeal against the High Court decision that the UK trade mark VETSURE (for pet insurance services) was not infringed by, and did not invalidate, the later use and registration of PETSURE (also for pet insurance services). The judgment provides helpful guidance for assessing likelihood of confusion in relation to issues of conceptual (dis)similarity, combinations of descriptive words and the proper interpretation of evidence of actual confusion.
