ملخص
As systems using Artificial Intelligence techniques continue to be developed and patent applications continue to be submitted, the judiciary and legal counsels need to have sound understanding and appreciation of the technology. Artificial Neural Networks (ANNs) are highly specialised computer science techniques in the field of Artificial Intelligence. It is essential that courts and adjudicators acquire a thorough understanding of ANNs and their implementation. Only when they are armed with a thorough technical understanding of ANNs can they apply the law correctly and fairly. This was pertinently illustrated in the 2024 UK Court of Appeal decision of Comptroller-General of Patents, Designs and Trade Marks v Emotional Perception AI Ltd. This article will dissect and expound the various missteps in the court’s understanding of the technology that led it to mis-apply the law with flawed reasoning.
