Summary
This article reviews the Court of Appeal’s judgment in Morley’s v Nanthakumar, in which it dismissed the defendants’ appeal against the Intellectual Property Enterprise Court’s ("IPEC") findings of trade mark infringement. This judgment largely reconfirms the approach adopted by the IPEC, but provides helpful appellate guidance concerning the characterisation of the "average consumer", the relevance of context of use in determining likelihood of confusion, the identification of allegedly infringing signs within a composite phrase, and the importance of expressly dealing with sub-licensing rights in any trade mark settlement and co-existence agreement.
