This short note analyses the April 2025 decision by Brazil’s antitrust authority, CADE, to investigate Ericsson’s licensing of 5G standard-essential patents (SEPs) following complaints from Lenovo and Motorola. The dispute centered on Ericsson’s refusal to grant Brazil-only SEP licenses, insisting instead on global cross-licensing. CADE’s intervention, despite a private settlement, reflects its view that SEP licensing practices have significant public interest implications. The note highlights how CADE’s approach draws on both Brazilian competition law and TRIPS flexibilities, emphasising the need for FRAND terms, territorial licensing, and non-discriminatory pricing to safeguard competition and innovation in Brazil.
