Artificial Music: Authorship and Copyrightability of Artificial Intelligence Musical Works

This Note focuses on the copyrightability of AI-produced musical compositions by focusing on how these works are created and who, if anyone, should hold the copyright. This is a question of at least three parts. First, what exactly is the copyrightable expression that underlies a musical work? What is it about a sequence of pitches, harmonies, rhythms, and timbres that constitutes an expression, and how do we identify it? Second, are works produced through neural networks and other AI programs capable of possessing the creative expression? If a work is created through an amalgam of human and AI interaction, is that expression still present? Is there a line where such a work is no longer protectable because it no longer possesses enough “originality”7 on the part of the human contributor, despite it being a creative work? Last, if an underlying copyrightable expression exists, who is that expression attributable to? Is the owner of the copyright restricted to the same person or people that created that expression, or does ownership extend to the programmer of the AI or even to the AI itself?
