The argument that copying paradoxically helps the fashion industry thrive may hold true when looking at the industry as a whole. For example, revenue from the apparel market in the United States alone totaled over 340 billion U.S. dollars in 2023. However, this viewpoint fails to adequately consider the negative impact the lack of copyright protections has on smaller independent designers who are often the ones coming up with the more creative designs. Unlike larger and more established brands, smaller independent designers are less likely to have the money and resources to continue creating after their designs have been copied and sold for mass consumption. This problem also takes on a unique form in the modern social media context in which larger and more established brands have greater access to designs from small designers who may only have an online presence.16 Small designers also respond on social media to Shein copying their designs. Viewing the problem through this lens, the lack of protection for fashion designers fails to promote innovation and creative expression.
