The United States' sectoral approach to privacy legislation has left these invasive practices largely unregulated. There is no federal law limiting the collection and sale of consumer biometric information and even if there was, Article III's concrete injury requirement would bar most plaintiffs from any judicial remedy. Intellectual property (“IP”) law can be used to control access to information, but consumers hoping to find solace in IP law will not fare much better as no current form of IP rights are compatible with the unique challenges of biometric data privacy. But times are changing and the emergence of blockchain technology has created a unique form of ownership in digital assets. Traditional characteristics of property such as scarcity and title can now exist in digital data. These features may be the key to giving consumers ownership and control over the data they share with companies.
