摘要
Issues related to the territorial nature of intellectual property (IP) and overcoming the obstacles generated by the principle of territoriality have long been of concern to both legislators and experts, as the framework of international conventions necessarily narrows the discrepancies between the IP rules of the individual countries.1 International legal harmonization is an evergreen topic in the field of IP law: on the one hand, it seeks to promote the creation of a balance between rightholders, society and users; on the other hand, there is no legal harmonization without gaps. The only question that remains now is whether it is possible, necessary or even permissible to fill these gaps. The authors of the reviewed volume are internationally recognized IP law (academic) experts who have undertaken to examine the difficulties of harmonization and the effects of discrepancies between EU Member States. The studies in the book present the individual sub-questions using comparative and analytical methods.2 Thus approaching the issues of legal harmonization from a distinctly unique perspective. This study cannot present and evaluate all the chapters contained in the volume, although they would all deserve a separate tribute. The focus of this review is rather on the analytical presentation of the writings, which topics are generally considered to be difficulties, and according to some views, obstacles, to legal harmonization and some global problems.
