A personal information handler is not someone who receives personal information under a simple contractual relationship, but rather someone who performs tasks under direct supervision and in a subordinate relationship with the personal information processor, acting in accordance with its directives. 2. Third parties and personal information handlers are distinct and mutually exclusive. 3. Based on this, the court qualifies sellers in an open marketplace as distinct personal information processors rather than personal information handlers subject to the marketplace provider’s guidelines and supervision.
