The five-year limitation period for the power of the Commission for the Protection of Competition to impose an administrative fine for an infringement of competition law is interrupted for the duration of the court proceedings. 2. The definition of the relevant market is fundamentally a technical issue involving complex economic assessments. The definition of the contested market may be the subject matter of limited review on the part of the court, focusing in essence on the accuracy of the facts, the existence of any manifest error in the appraisal of one of those facts, and the accuracy of the legal conclusions drawn. Supreme Constitutional Court, judgment of 6 September 2023 – 60/2016 LIATSOS, PRESIDENT: Both the substantive matters under consideration and the facts surrounding the present Review Appeal are similar to those addressed by the Court in Review Appeal 129/2015 of 2 November 2022 between the same parties.
