Extract Criminal Code, Art. 270; Royal Legislative Decree 1/1996, Art. 10.1.(e) ‒ Desigual Headnote by the Editorial Office The unauthorised commercialisation of a work of applied art, even if incorporated into useful objects, falls within the scope of protection provided by Art. 270 of the Criminal Code. Such protection is granted to the creator of any artistic work whose genuine authenticity and creative originality can be ascertained and which goes beyond the mere value attributed to it from the subjective perception of somebody contemplating it.
