It is not permissible to benefit from cultural expressions of indigenous peoples, since they form part of the protected intangible cultural heritage. 2. The court confirms the refusal of registration for the three-dimensional sign, which imitates a monolithic sculpture that is part of the intangible cultural heritage of indigenous people. The sign is deemed descriptive, lacking distinctiveness, and liable to mislead or deceive.
