Extract Intellectual Property Code, Arts. L.111-l and 112-2 7 – Orangerie Éphémère Headnotes by the Editorial Office 1. When the originality of a work of the mind is disputed, it is for the person claiming copyright protection to identify what characterises that originality. More specifically, such a person is required to justify that the work claimed has its own character, reflecting an aesthetic position and the personality of its author. 2. Originality can result from a particular combination of known elements. 3. The concept of anteriority is irrelevant in copyright matters. Paris Court of Appeal (Cour d’appel de Paris), judgment of 9 October 2024 – RG 22/20264 Facts: Founded in December 1997, Va Evènements specialises in the organisation of events, including the hire of venues and reception marquees. It states that in 2007 it created a type of top-of-the-range temporary structure for which it used the services of a technical illustrator, Mr [G] [K], a structure marketed under the name ‘Orangerie éphémère’. It also registered the French word/picture trade mark ‘L’Orangerie Ephémère’ on 23 August 2007.
