Summary
Patent Act, Secs. 29(1), 184quinqies(1) – DABUS Japan Headnotes by Atsuhiro Furuta 1. The Patent Act does not envisage that an invention can be autonomously made by artificial intelligence (AI) and there is no legislative intention to protect such an AI invention by granting a patent. An ‘invention’ within the meaning of Sec. 29(1) Patent Act is limited to inventions made by a natural person. 2. Indicating the ‘inventor’s name’ in the domestic document of an international patent application under Sec. 184quinqies(1) Patent Act is a necessary requirement. As the Patent Act presupposes that the inventor is a natural person, the inventor’s name to be stated in the patent application document is that of a natural person.
