ملخص
Under European Union trademark law, the mandatory indication of the goods and services according to the Nice Classification is paramount for assessing the scope of protection of a mark (except for a mark with a reputation). Likewise, using a description of the mark may be relevant when determining the subject matter of the mark (where a description is required or recommended). Things are different, for very good reasons, under established EU design law and practice. Unfortunately, a recent decision of the EU’s General Court (T-202/22, TA Towers v EUIPO, ECLI:EU:T:2024:28) departs from these standards and opens Pandora’s box.
