Summary
With the UPC now well under way, we are starting to see what direction the court is taking on many important topics: claim construction, the test for inventive step and the standard and burden of proof for preliminary injunctions, to name just a few. In this article, I will summarize where we are and will also identify some points where much-needed guidance from the court of appeal (or even the CJEU) is eagerly awaited.
