The book Counterfeit Goods and Organised Crime by Michael Blakeney, Winthrop Professor of Law at the University of Western Australia, examines how counterfeits are leveraged by criminal organizations and explores their negative effects on society. The work is divided into four parts, each addressing an aspect of this issue at the intersection of private and criminal law. The first part focuses on definitions, relevant metrics and applicable anti-counterfeiting legislation, providing a foundational understanding and context for the phenomenon. The second part delves into confiscating the proceeds of counterfeiting, exploring the financial dimensions and legal mechanisms involved in seizing illicit gains. The third part presents case studies—including luxury goods, wines, pharmaceuticals and toys—offering real-world examples that illustrate the everyday effects of the phenomena. The final part provides recommendations, suggesting changes in strategies and policies to combat counterfeiting more effectively. Prof Blakeney’s book makes a significant contribution to the existing literature on counterfeiting by exploring the underestimated societal implications of IP infringement. Indeed, IP violations extend far beyond mere economic losses and reputational harm for rightsholders; they fund organized crime and terrorist organizations and generally pose significant risks to public safety.
