The High Court’s decision concerned the nature, validity and scope of Moderna’s pledge regarding their COVID-19–related patents. The court examined the concept of consent in relation to patent infringement as well as the application of conflict of law principles. A patent pledge can be regarded as a voluntary public commitment made by a patent holder to refrain from exercising some or all its rights in one or more patents. Such public commitments to limit the enforcement—or other exploitation of their patents—are typically directed to the public at large or a segment of a market without direct compensation.
