The Research Handbook on Intellectual Property Rights and Arbitration, compiled and edited by Simon Klopschinski and Mary-Rose McGuire, is, as promised, an effective and comprehensive introduction for a researcher or practitioner considering the trend towards alternative dispute resolution for IP rights (IPR). Klopschinski (Partner at Rospatt Intellectual Property Lawyers) and McGuire (Professor for IP-law and Civil Procedure at the University of Osnabrück) make a formidable team, combining a crucial understanding of practitioner concerns with a critical engagement in research. IPR are increasingly important as the value of IP assets grows. As their importance and worth increase, so too do the number and range of disputes. In the globalized commercial environment in which many businesses now participate, understanding how best to recognize and enforce these rights (which are often jurisdictionally specific) can be a challenge. This escalating issue is what the book specifically seeks to address, focusing in particular on the possibility of using alternative dispute resolution mechanisms (going beyond the titular arbitration) to more effectively tackle the issues that can emerge adjacent to these rights.
