Intellectual Property Code, Art. L. 112-1, L. 112-2, 9, L. 121-1 and L. 121-2(1) – Photographer [F] [Z] [B] and Amo Films v RATP Headnotes by the Editorial Office 1. A photograph that is the result of arbitrary creative choices bearing the imprint of the photographer’s personality meets the originality requirement. 2. Mentioning the photographer’s name without specifically linking it to the photograph amounts to an infringement of the right to a name. 3. The alteration of a photograph that does not result in aesthetic distortion does not constitute an infringement of its integrity. 4. In the case of an exhibition where access by the external public is only incidental to the internal use and no commercial use or advertising is made, the display of photographs for which reproduction rights were granted solely for internal use does not violate economic rights.
