Résumé
Extract Intellectual Property Law, Arts. 18, 21 and 139.1 ‒ Kukuxumusu Headnotes by the Editorial Office 1. Assigning rights over character drawings does not equal assigning rights over the characters. 2. The reproduction right refers to each of the drawings that have been assigned, but not to other possible drawings of the same characters, as long as they are sufficiently different so as not to be considered a plagiarism of any of the assigned drawings. 3. The transformation right should be assigned in respect of a specific work and for a given transformative act. The transformative activity that falls outside the scope of the assigned transformative rights does not constitute infringement. 4. The order to cease and, more specifically, the order preventing resumption of the infringing acts must be in line with the actual infringement. Supreme Court (Tribunal Supremo), judgment of 19 December 2023 ‒ STS 5648/2023 Factual background ONE: Processing at first instance
