Headnotes by the Editorial Office 1. The offence under Art. 136 Sec. 2 No. 1 of the Copyright Act aims at protecting the moral rights of authors or performers as well as their honour, the latter being interpreted as socially recognised honour. 2. For the purposes of establishing the referred offence, it is sufficient that there is a risk that the social esteem or recognition of an author or performer will be harmed by infringement of their moral rights. The said risk is to be assessed in light of objective circumstances. 3. The mere act of infringement of the moral rights of an author or performer does not necessarily mean that there is such a risk.
