In some jurisdictions, most notably the United States, judicial decisions expressing a reluctance to grant overlapping intellectual property rights in pictorial trademarks have held that a design trademark cannot, at least in some circumstances, be the subject of copyright protection. In Canada, there is no such prohibition.
