Compulsory licences provide a mechanism by which the competing interests of the copyright owner and user may be balanced. The user may be disadvantaged by mental or physical handicap or the countervailing power of copyright owners in particular industries. The compulsory licence has proved to be a flexible legislative solution. The Australian Copyright Act 1968 (Cth) provides for ten types of compulsory licences. This article outlines the purpose, nature and types of compulsory licences under that Act;.
