In Numatic International Limited v Qualtex UK Limited [1], the claimant Numatic successfully secured an injunction preventing the defendant Qualtex from placing on the market a replica of the famous "Henry" vacuum cleaner. The decision is of interest since the claim was based on unregistered rights in the appearance of the Henry, and discusses the care that needs to be taken with survey evidence.
