When was the last time an English court has launched such overt criticism of a ruling from the Court of Justice of the European Union, as happened in the recent case of L'Oréal v Bellure? Having strongly objected, however, the Court of Appeal did exactly what it should do...and duly applied the ruling that it had just criticised.
