In the current economic climate, IPR owners must maintain their vigilance against the international trade in counterfeit and piratical goods that infringe their trademarks and copyrights. A coordinated global approach to IPR enforcement is often advisable. Thanks to increasingly effective IPR enforcement tools used by governmental border agencies, as well as better cooperation and information sharing among those agencies, such a coordinated approach is a possibility for companies wishing to protect their brands in key markets, such as the United States and Europe. This article describes recent trends in U.S. Customs & Border Protection ("CBP") interdiction of infringing merchandise at the borders, as well as the merits of working closely with CBP to improve U.S. border enforcement for one's trademarks and copyrights.
