The CJEU is to consider what powers customs authorities should have to seize goods in transit. Beverley Potts of Baker Mackenzie gives her view on the key questions. What powers do customs authorities have to seize counterfeit goods in transit through the UK? That is the question that the The Court of Justice of the European Union (CJEU) has been asked to consider. The request stemmed from a dispute between Nokia Corporation ("Nokia") and HM Revenue and Customs (HMRC) regarding HMRC's refusal to seize counterfeit mobile phone equipment intercepted at Heathrow en route from Hong Kong to Colombia.
