That is the question that the The Court of Justice of the European Union (CJEU) has been asked to consider. The request stemmed from a dispute between Nokia Corporation ("Nokia") and HM Revenue and Customs (HMRC) regarding HMRC's refusal to seize counterfeit mobile phone equipment  intercepted at Heathrow en route from Hong Kong to Colombia.
