Supreme People’s Court, judgment of 23 June 2022 ‒ (2021) Zui Gao Fa Zhi Min Zhong No. 1977 Lijie Ma, appellant in the present case, has been involved with China Mobile Communications Group Henan Co. Ltd (hereinafter ‘China Mobile Henan’) (respondent in the present case) in a dispute concerning abuse of a dominant position. The appellant wishes to challenge a civil judgement (Case No. (2021) Yu 01 Zhi Min Chu No. 596) issued on 26 July 2021 by the Intermediate People’s Court of Zhengzhou City, Henan Province (hereinafter ‘the court of the first tial’) and appealed to this court. The court formally accepted the case on 8 November 2021 and formed an appeal panel according to the law. On 28 December 2021, Lijie Ma, the appellant, and Jiang Tao, agent ad litem of China Mobile Henan, the respondent, attended the appeal hearing during which both parties were questioned and cross-examined. The case has now been concluded.
