If a Protected Designation of Origin (PDO) and a trade mark do not refer to the same class of product, the owner of the PDO cannot invoke the protection afforded by Council Regulation (EC) No. 510/2006. 2. When the comparison is between a PDO and a trade mark, reference to the product categories of the Nice Classification is irrelevant. 3. To identify the scope of protection of the PDO, the description of the product and the method of obtaining it must be considered, both in the specifications and in the registration application.
