Résumé
This chapter argues that the dynamics involved in trade negotiation within the knowledge economy originate from the cultural and economic interests in regional biological resources and their associated (traditional) knowledge. Because of the public good nature of assets in the knowledge-based economy, patent claims are increasingly seeking unfair competition and illegitimate trade barriers in agriculture. The issues are explored by contrasting multilateral negotiations over genetic resources (GRs) with bilateral negotiations on trade in wine. The chapter also revisits the biopiracy case over basmati rice, which is a valuable GR and knowledge resource.
