This Note will explore some of the more well-known cyberbullying incidents and judicial treatment of legislation aimed at cyberbullying from North Carolina and Albany County in New York, both of which were ultimately struck down as unconstitutional. In doing so, this Note will provide an in-depth analysis of what courts have said about some current legislation. Lastly, this Note will offer (i) suggestions to some of the constitutional issues that cyberbullying legislation may run afoul of, and (ii) propositions for statutory construction for future cyberbullying legislation based on previous courts’ findings and comments.
