Résumé
This Note explores the possibilities of modifying, or eliminating, the Franchise Tag. Part I of this Note will provide an in-depth description of the NFL Franchise Tag and its history. Part II will discuss non-compete clauses, specifically the factors that determine whether a non-compete clause is enforceable. Part III of this Note will discuss how the Franchise Tag has the practical effect of a non-compete clause and why it would be unenforceable if it were part of a regular employment contract. Part IV of this Note presents two proposals for how to remedy the problems associated with the Franchise Tag in an attempt to satisfy both the owners and the players.
