Specifically, the contributors look at measures that regulate the acquisition, recognition, and use of patent rights on pharmaceuticals and trade secrets in data concerning them, along with the conditions under which these rights expire so as to permit the production of cheaper generic drugs. In addition, the book includes commentary from scholars in human rights, international institutions, and transnational activism. The case studies presented from 11 Latin American countries, have many commonalities in terms of economics, legal systems, and political histories, and yet they differ in the balance each has struck between proprietary interests and access concerns. The book documents this cross-country variation in legal norms and practice, identifies the factors that have led to differences in result, and theorizes as to how differentials among these countries occur and why they endure within a common transnational regulatory regime. The work concludes by putting the results of the investigations into a global administrative law frame and offers suggestions on institutional mechanisms for considering the trade-offs between health and wealth. 000027487 650_0 $$aPatent medicines$$xLaw and legislation$$zLatin America. 000027487 650_0 $$aPharmaceutical policy$$zLatin America. 000027487 650_0 $$aDrug accessibility$$zLatin America. 000027487 650_0 $$aDrugs$$xPatents. 000027487 650_0 $$aConflict of laws$$xIntellectual property$$zLatin America. 000027487 650_0 $$aDrugs. 000027487 650_0 $$aIntellectual property$$zLatin America. 000027487 650_0 $$aIntellectual property$$zUnited States. 000027487 650_0 $$aPatents$$zUnited States. 000027487 650_4 $$aIntellectual property 000027487 650_4 $$aAccess to medicines 000027487 651_0 $$aAmerica$$xCommerce$$xLaw and legislation. 000027487 651_0 $$aLatin America$$xCommerce$$xLaw and legislation. 000027487 7001_ $$aRochelle Dreyfuss,$$aCésar Rodríguez-Garavito,$$aTatiana Andia,$$aPaola Bergallo,$$aAgustina Ramon Michel,$$aAngelina Snodgrass Godoy,$$aSalvador Millaleo,$$aMonica Steffen Guise,$$aAdelina de Oliveira Novaes,$$aLaurence Helfer,$$aKaren Alter,$$aSmita Narula,$$aSean Flynn,$$aAmy Kapczynski,$$aMolly Land,$$aRuth Okediji.$$eContributors. 000027487 830_0 $$and Global Governance Series. 000027487 85641 $$uhttps://doi.org/10.1093/acprof:oso/9780199676743.001.0001$$yView eBook 000027487 903__ $$aLaw and Global Governance Series 000027487 942__ $$2ddc$$cMON 000027487 952__ $$w2015-02-24$$p2015-0033$$r88.65$$u41991$$bMAIN$$10$$kF 32 DRE.B$$v2015-02-24$$zTagged$$70 000027487 980__ $$aBIB 000027487 999__ $$c29927$$d29927
