This article argues that according to the environmental provisions of the EC Treaty, patent laws should take environmental concerns and especially the problem of global warming into account. The second and final part of the article reviews the several possible systems that can be put in place within patent laws to reduce greenhouse gas (GHG) in the atmosphere, determines which one is best, how to ascertain the eco-friendliness of an invention and who bears this burden of proof.
