This article examines the patent protection for business method inventions and practice in China. The amendment to the Guidelines for Examination in 2006 changes the examination principles relating to rules and methods for mental activities. In spite of strict technical requirements, business method inventions are patentable in China. The comparison between China and Europe shows that SIPO has followed EPO to a great extent. The research concludes that the treatment for business method patents in the SIPO considers both China's legislative target and development context of the e-commerce industry.
