Internet service providers and other internet intermediaries rely largely on the safe harbours provided by the E-Comm Directive and its national transpositions to avoid liability for third party contents. This article discusses how the key requirement of lacking 'actual knowledge' has been transposed into Spanish Law and how Spanish courts have been interpreting it so far.
