The article examines the patent 'trolls' phenomenon by studying the techniques of the 'trolls' in the patent 'thicket' marketplace. It examines the arguments in favour of patent 'trolls' and compares the proliferation of trolls in the United States and European Union. Subsequently, it argues that it is time to confine the patent 'troll' to history and deal with patent system failures head-on.
