The focus of this article is to consider the application of the exclusion of methods of medical treatment as it relates to animals, paying specific attention to the considerations that the Technical Boards of Appeal (TBAs) of the European Patent Office (EPO) have had to grapple with when considering such patent applications. This article will also briefly examine the preparatory documents relating to the European Patent Convention (EPC) to first find out whether they can throw any light on the rational for and interpretation of the exclusion from patent protection of methods of medical treatment of animals and, secondly, determine whether the approach taken by the TBAs mirrors the intention of the drafters of the EPC.
