This discussion paper was written against the background of a review by the Commonwealth Attorney-General's Dept. that focussed on whether or not Australia should introduce a "fair use" exception or an open-ended "fair-dealing" provision into Australian copyright law. This paper: provides information on the international copyright treaties to which Australia is a signatory; discusses fair use, both generally and in relation to several particular situations, such as creative contexts, educational institutions, libraries, archives and cultural instutions, and; in relation to those specific situations, analyses relevant available submissions to the Attorney-General's Dept. review.
